A genuine gateway to employment and qualifications, this form of training is based on alternating periods of theoretical instruction and practical training on the job.
Why choose a work-study program?
Students on apprenticeship or professionalisation contracts are employees in their own right. They are therefore subject to the same legal and regulatory framework as the company's other employees, and enjoy the same benefits and obligations.
The work-study student's role
Students have obligations and duties:
1. Apprentices are responsible for their integration into the company and their academic success. They are supported by their apprenticeship supervisor, with whom they establish a constant dialogue, and their university tutor.
2. The apprentice is obliged to attend the entire training course regularly.
3. They must respect the organization of the company and the training establishment.
4. During the training period, the apprentice must comply with the training center's internal rules. The employer has disciplinary powers and can punish the apprentice if he or she fails to attend training: withholding of wages, possible termination of the contract in the event of systematic absenteeism, or expulsion from the training center.
5. The apprentice is obliged to pass the assessments and exams required to acquire the qualification sought.
2 types of contract on offer
● Apprenticeship contract
Trial period & breach of contract
There is a 45-day probationary period in apprenticeship, during which both employer and apprentice are free to break the contract, without compensation or reason. The termination must be formalized in writing and signed by both parties.
Termination after the trial period
Once the trial period is over, the contract can only be terminated in certain circumstances:
termination by mutual agreement (using the termination form downloadable from the FORMASUP website)
termination at the apprentice's initiative after compulsory referral to the apprenticeship mediator (mediation is a compulsory preliminary step prior to any unilateral termination)
serious misconduct, force majeure (economic difficulties of the company, etc.)
● Professionalisation contract
Trial period & breach of contract
The trial period is one month, during which either party may terminate the contract.
Termination after the trial period
Termination is only possible in the following cases:
termination by mutual agreement (using the online termination form)
termination for reasons of permanent employment
serious misconduct, force majeure (economic difficulties of the company, etc.).
In all cases, the CFA and the training organization must be informed.
CVEC
- Students on apprenticeship contracts (part of initial training) are subject to the CVEC.
- Work-study students on professionalization contracts (part of the continuing education system) are not subject to the CVEC.
What should I do if I'm absent due to illness?
If you are absent from work, you must provide a work stoppage slip from the very first day. The procedure to follow is the same as for a full-time employee: send the company and the social security authorities the parts of the work stoppage intended for them. However, if the absence occurred during the training period, the certificate or work stoppage must be sent to the training secretariat.
Can I receive the grant if I'm on a sandwich course?
No. However, work-study students are not considered simply as "classic" students, as they are also salaried employees of a company during their training. In fact, an apprentice cannot receive a CROUS grant during his or her work-study contract, as these grants are only available to students.
Can I receive the activity bonus?
Yes, it is intended for working people over the age of 18. You are entitled to this bonus if you earn a minimum wage equivalent to 78% of the minimum wage. It is paid by the CAF and the amount varies according to your salary.
Revision leave
Apprentices on an apprenticeship contract are entitled to an additional 5 days paid leave in the month preceding the exam. Apprentices on professionalization contracts are entitled to an additional 5 days unpaid leave. Revisions are therefore made during rest periods or paid leave.
Assistance for apprentices
Apprentices can benefit from a number of grants: housing, relocation, Zou card, driving license, international mobility, first equipment, etc.
To find out what assistance your apprentice is entitled to, please contact your CFA. Ask your schooling manager, Ms Myriam Attard (ejcam-scol-contact@univ-amu.fr).
